Californian who feels ‘male and female’ suing British Government to be recognised as ‘non-binary’

An American IT worker living in the UK who feels ‘both male and female’ is suing the Government in order to be officially recognised as ‘nonbinary’.

Ryan Castellucci, a biological male from California, has had surgery to create a ‘fully functional’ vagina but also retains a penis, and goes by ‘they’, rather than ‘him’ or ‘her’.

While Gender Recognition Certificates (GRC) confirm one’s switch from male to female or vice versa, there is no option to be recognised as ‘nonbinary’ in the UK.

‘In the current state of affairs, I don’t even know as a matter of law what my legal gender is in the UK,’ they said in a witness statement to the Family Court, which is hearing the case. ‘It is striking and profoundly upsetting that I do not know how my gender would be recorded on my death certificate.’

The Government is resisting the claim. A spokesman at the Government’s Equality Hub said: ‘The gender recognition process in UK law only allows a change of sex from male to female or vice versa.’

The spokesman added: ‘Given the ongoing legal proceedings in this case we won’t be commenting on any further on this individual case.’
